In consideration of my, and/or my children or wards, as applicable, use of the tennis and exercise equipment and facilities, and tennis and exercise instruction, provided by or on behalf of Launchpad Tennis, LLC and/or The Toledo Tennis Club, Inc. (together, the “Releasees”), I expressly agree and contract, on behalf of myself, and/or such children or wards, as applicable, that the Releasees and their respective insurers, employees, independent contractors, agents, officers, directors, and other representatives (collectively, “Representatives”), shall not be liable for any damages arising from personal injuries sustained by me, and/or such children or wards, as applicable, in, on, or about the premises of Toledo Tennis Club or such other venue in which Launchpad Tennis may be providing instruction, or as a result of the use of the equipment or facilities or any tennis or exercise instruction, regardless of whether such injuries result, in whole or in part, from the negligence of any Releasee. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me, and/or such children or wards, as applicable, and hereby fully and forever release and discharge the Releasees and their respective Representatives, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facilities and instruction. I expressly agree, on behalf of myself, and/or such children or wards, as applicable, to indemnify and hold the Releasees and their Representatives harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me, and/or my children or wards, as applicable. I agree to comply with all rules imposed by the Releasees regarding the use of the facilities and equipment, and/or to direct such children or wards to do the same, as applicable. I understand and acknowledge that the use of tennis and exercise equipment and instruction involves risk of serious injury, including permanent disability and death. I understand and agree that the Releasees are not responsible for property that is lost, stolen, or damaged while in, on, or about the premises of the Toledo Tennis Club, or such other venue as Launchpad Tennis may be providing instruction.

I hereby grant Launchpad Tennis, LLC permission to use my, and/or my children/wards, as applicable, likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of Launchpad Tennis, LLC and will not be returned. I hereby irrevocably authorize the Launchpad Tennis, LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
